site”, “we”, “us”, “the service”) you agree to be bound by the Terms of Service
set forth herein ("TOS" or "Agreement").
If you wish to become a member of the ConnectionCafes.com
service (the "Service") and enjoy its many benefits, please read this
Agreement CAREFULLY and indicate your acceptance of its terms and conditions by
clicking in the acceptance boxes provided on Post Profile Basics and Subscribe
pages. You may print this agreement for your records, and it is accessible to
you at www.connectioncafes.com on the bottom navigation panel on any page.
ConnecetionCafes.com reserves the right to modify the Terms
of Service from time to time. You agree
that all such modifications shall become effective immediately upon posting by
ConnectionCafes.com on the Web site.
ConnectionCafes.com reserves the right to send you e-mails connected
with the Service and/or by posting a notice in My Messages > Site Notices.
Regardless, by visiting or logging onto you account at the site, you
acknowledge and accept changes to the ConnectionCafes Terms of Service.
ConnectionCafes has combined the best of both the real world
and virtual world to give you a real chance to connect. With sophisticated online search and a
variety of ways to connect online including live video/voice one on one chat,
private mailbox messaging, Bulletin Boards including 'Ask Me Out', Missed
Connections and Daily News Chats, coupled with the ability to invite other members to your own
events/parties and be invited to their own, we make it easy to find and connect
to your perfect match, new friends and new experiences. With total control over which members and
types of members can contact you your online experience is always one where
you et all the attention you are looking
for without any unwanted attention. With
a growing network of participating 'ConnectionCafe' Affiliates' we offer safe
and exciting alternatives to meeting offline rather than some random location,
as well as a whole new forum for getting your profile out there or finding
profiles of people you want to meet; hardcover 'Matchbooks' in cafes,lounges
and wine bars filled with the types of people you are looking to meet and the
types of people looking to meet you.
1.
General
Terms and Conditions
a. Member's Personal Information
ConnectionCafes.com
shall take best reasonable efforts to protect your personal information. You agree that the personal information you
provide shall be stored in our computers and may be used by ConnectionCafes.com
for the facilitation of the Service or the operation of the Web site. You have the right to access, modify or
delete personal information, and suspend your profile from being viewable at
any time.
b. Eligibility
You must be eighteen
or over to be registered as a member of this Service or to use the Web
site. By registering as a member or by
using the Web site, you represent and warrant that you are over the age of 18
and have the right and the capacity to enter into this Agreement.
c.
Commercial Use by Members
The Service and
the Web site are for the personal use of individual members only. The Service and Web site may not be used by companies,
businesses or organizations, which are strictly prohibited from becoming
members. Any use of the Service or the
Web site, or of any Content contained therein, for any commercial enterprise or
in connection with any commercial enterprise is strictly prohibited. ConnectionCafes.com shall take any and all
legal actions available to it against any unauthorized or illegal use of the
Service or the Web site.

Content

You agree and acknowledge that all information, sound, graphics, video,
text, photographs, messages or other related materials ("Content"),
are the sole responsibility of the originator of such Content. You further agree and acknowledge that you
are solely responsible for all Content that you post, email, transmit or
otherwise make available while using the Service. You agree and acknowledge that
ConnectionCafes.com has no control over the Content posted by users of the
Service. Nor can ConnectionCafes.com guarantee the accuracy, quality or integrity
of any such Content. You understand that
by using the Service, you may be exposed to Content that is offensive, indecent
or objectionable and you agree that under no circumstances will
ConnectionCafes.com be liable in any way for any Content posted, emailed or
otherwise made available via the Service.

You agree and understand that ConnectionCafes.com does not guarantee the
quality, accuracy or the timely posting of any Content and that you are solely
responsible for any such Content.
3.
In consideration of your use of the Service, you agree to: (a) be true
and accurate when completing the registration form ("Registration
Form"), and (b) immediately update your Registration Form to keep it true
and accurate. ConnectionCafes.com
reserves the right to suspend or terminate your account if you provide
information that is untrue or inaccurate, or when ConnectionCafes.com suspects
that such information is untrue or inaccurate and where you are unable to
justify such information upon the request of ConnectionCafes.com to do so.You
agree and acknowledge that ConnectionCafes.com may disclose or preserve Content
if required to do so by law or in the good faith belief that such disclosure or
preservation is reasonably necessary to: (a) comply with legal process; (b)
enforce the Agreement; (c) respond to claims that any Content violates the
rights of third-parties; or (d) protect the rights, property, or personal
safety of ConnectionCafes, its users and the public.

By posting Content in or by requesting Content to be posted online on
the site or printed in MatchBooks ConnectionCafes.com, you grant
ConnectionCafes, Inc an irrevocable, non-exclusive, perpetual, royalty-free,
worldwide license to use, copy, display, distribute, reproduce, modify, adapt, publicly
display, and grant and authorize sublicenses or any such Content for the stated
purposes of online display and matchbook prints and /or any other purposes
related to the service
5.
You understand and agree that ConnectionCafes.com may review, delete or
choose not to display online or print in MatchBooks any Content that in its
sole discretion violates this Agreement or which might be offensive, illegal,
or is otherwise objectionable.
6.
Content Guidelines
The following is a partial list of the kind of Content that is illegal or
prohibited on the Web site (including your personal profile and any messages
you sent to other user via instant message, chat or on the public forums) or in
our printed Matchbooks. It includes Content that:
1.
Is harmful, threatening, false, misleading, unlawful, illegal, abusive,
harassing, vulgar, tortious, defamatory, obscene, libelous, violates another's
privacy, or that promotes racism or bigotry or any form of hate.
2.
Includes URLs, websites, pages that are restricted or password protected
or hidden pages or images.
3.
Provides detailed descriptions of preferred sexual activities and
physical characteristics, such as sizes and measurements.
4.
Includes full names, email address, phone number, street address, or
other users profiles or IDs.
5.
Involves the transmission of unsolicited or unauthorized advertising,
promotional materials, "spam", "junk mail," "chain
letters," "pyramid schemes," or any other form of solicitation,
including and in particular solicitation of passwords or personal information
for commercial use.
6.
Promotes the copying of copyright-protected work, including providing
pirated music or computer programs or links to them, or providing information
on how to circumvent devices that protect copyrighted work.
7.
Includes information or data that is protected under law or contractual
or fiduciary relationships and which you do not have a right to make available,
including inside information, information learned under a nondisclosure
agreement, or during employment relationship.
8.
Includes pornographic or sexually explicit material of any kind
9.
Provides material that is or might be harmful or dangerous to people
under the age of 18 or that exploits such people in any way and in particular
in a sexual or violent manner, or that solicits the personal information of
such people.
10.
Includes, transmits or uploads any material that contains software
viruses, Trojan horses or any other computer code or program that is designed
to destroy, interrupt or limit the functionality of computer software or
hardware or telecommunications equipment or that in any way causes or might
cause damage to the Service, Web site or any of its Members or users.
11.
Forges headers or otherwise manipulates identifiers in order to disguise
the origin of any Content transmitted through the Service, or post or gather ad
information using automated tools, unless specifically authorized.
12. Violates any local, state, national or international law, including any rules or regulations having the force of law.
13.
Contains incomplete, false or "fluff" or nonsensical information/answers intended to create a record
14.
Includes a photo if you are not in it, and/or;
1.
your face is blurred and/or
2.
it contains an image of a child and/or
3.
Includes pornographic, sexually explicit images or nudity
4.
it contains more than two recognizable people and/or
5.
it contains copyrighted material and/or
6.
it contains recognizable street addresses or text, and/or
7.
it is something other than a non-animated GIF or JPEG file greater in
size than 150kb and/or
8.
it is not right side-up.
ConnectionCafes, Inc. reserved the
right to reject a photo at it's sole
discretion.

Matchbooks
Members with approved profiles may request to have their profiles printed in
hardcover volumes at any participating ConnectionCafe. This request can only be
made by visiting a Café’ dedicated page (Find Cafes Page) and clicking on the “Print
Me Here” button on the top panel.
Additional fees may apply and you will be notified at the time of your
request of the cost and given the option to proceed or cancel.
a.
Privacy
AS YOUR MATCHBOOK PROFILE IS A PRINTED VERSION OF YOUR ONLINE PROFULE, NEITHER
YOUR PERSONAL INFORMATION NOR YOUR EMAIL ADDRESS IS PRINTED AND ONLY
CONNECTIONCAFES MEMBERS WITH PROFILES CAN CONTACT YOU AFTER READING/VIEWING
YOUR PROFILE AND THEN ONLY THROUGH OUR “ BLIND” MAILBOX/FORUM/CHAT SYSTEMS. WE
ASSUME NO RESPONSIBILITY OR LIABILITY SHOULD YOU CHOOSE TO SHARE PERSONAL
INFORMATION OR PERSONAL CONTACT INFORMATION WITH OTHER MEMBERS. SEE PRIVACY
STATEMENT FOR COMPLETE DETAILS.
b.
the
Matchbooks and all pages including any you may be printed on at your request
are the sole property of ConnectionCafes, Inc. and may not be remove or
defaced, in whole or in part, from the
ConnectionCafes they are delivered to.
c.
Warranty
CONNECTIONCAFES INC. WARRANTS ONLY THAT IT WILL PRINT YOUE
PROFILE IN THE GENDER-SEEKING-GENDER CATEGORY (E.G. M4W) ASSOCIATED WITH YOUR
PROFILE AND DELIVER IT TO THE PARTICIPATING CONNECTIONCAFÉ YOU REQUESTED
IF/WHEN YOU EXPRESSLY REQUEST FOR YOUR PROFILE TO BE PRINTED AT THAT CAFÉ WHILE
LOGGED ON TO YOUR ACCOUNT AT CONNECTIONCAFES.COM
d.
Cancelling/Refunds
Once you place an order online to be printed in any specific
ConnectionCafe(s) it will be placed in a queue until enough other members for
that café and in your gender-seeking-gender category have likewise requested
Matchbook Prints. You can find a list of the Mathcbooks you are queued to be
printed in at any time while logged into your account at the site from the My
Settings Page > My Matchbooks: Queued to Print In. You may cancel printing
at any time before it goes into print production after which you may not cancel
and no refunds will be given for any reason.
If there was a fee associated with printing the credit-card you provided will
not be charged until the Matchbook your Profile will appear in is in print
production.
If we could not bill the credit-card you provided at the time of print
production, you will be removed from the queue and you will receive an email
informing you that your credit-card could not be charged.

CONNECTIONCAFES.COM MAKES NO WARRANTY THAT:
i.
YOUR PHOTO AND/OR PROFILE WILL APPEAR
IN MATCHBOOKS IN A TIMELY MANNER. MATCHBOOKS ARE PRINTED FOR INDIVIDUAL
PARTICIPATING CAFES WHEN A SUFFICIENT # OF NEW MEMBERS (MINIMUM 52) FOR ANY
GIVEN CATEGORY (M4W, W4M, M4M, W4W) REQUEST TO BE PRINTED IN THAT CAFÉ. MEMBERS ARE ADDED TO THAT PRINT QUEUE IN THE
ORDER THEY SUCCESFULLY MAKE A PRINT REQUEST/ORDERIS ONLINE AT WWW.CONNECTIONCAFES.COM.
ii.
YOUR PHOTOGRAPH WILL BE TO YOUR
SATISFACTION. YOU ARE RESPONSIBLE FOR UPLOADING AN IMAGE OF SUFFICIENT
RESOULTION TO PRINT LEGIBLY (200 PIXELS WIDE AND/OR HIGH IS RECOMMENDED)
iii.
THE MATCHBOOKS WILL NOT BE LOST,
STOLEN, OR DEFACED ONCE DELIVERED TO THE PARTICIPATING CONNECTIONCAFE. THIS
APPLIES TO BOTH MATCHBOOKS YOU HAVE BEEN PRINTED IN FOR FREE AS WELL AS THOSE
YOU HAVE PAID TO BE PRINTED IN. UNDER NO CIRCUMSTANCES ARE REFUNDS DUE FOR
MATCHBOOK PRINTING DUE TO LOST, STOLEN OR DEFACED MATCHBOOKS ONCE THE CAFE HAS
TAKEN DELIVERY OF THEM.
f.
Limitation
of Liability
i.
YOU EXPRESSLY AGREE AND UNDERSTAND THAT
NEITHER CONNECTIONCAFES, INC NOR ANY CONNECTIONCAFES CAFÉ PARTICIPATING CAFÉ
SHALL BE LIABLE FOR ANY LOST, DEFACED OR STOLEN MATCHBOOKS IN WHICH YOU HAVE
REQUESTED TO AND/OR PAID TO BE PRINTED IN ONCE THE PARTICIPATING CONNECTIONCAFES
AFFILIATE HAS TAKEN DELIVERY OF THE MATCHBOOK AND THE BOOK HAS BEEN MADE
AVAILABLE TO THE GENERAL PUBLIC FOR VIEWING.
f.
Events
Both ConnectionCafes Affiliates and Members may post events
on the site. Depending on whether the Member
chooses to post a Public, Semi-Public, Private or Semi-Private Event these
Events may or may not be seen by all visitors to the site, just members, just
members meeting specific criteria, or just member specifically invited by the
host.
a.
Opt-out
of Invitations
If you do not wish to receive email notifications from
ConnectionCafes if/when you are invited to an event by a Café/Member you may
opt-out of such communications from the My Settings Page > Email
Notifications > Events while logged into your account at the site. You can
search on upcoming events from the Find Events page and find a list of Events
you are specifically invited to from Find Events > My Events > Events I
Am Invited to regardless of whether you have opted-out of receiving email notifications
or not.
b.
Limitations of Liability
You agree and
acknowledge that ConnectionCafes.com has no control over the Content posted by
users of the Service. Nor can ConnectionCafes.com guarantee the accuracy,
quality or integrity of any such Content.
You agree and acknowledge that YOUR PARTICIPATION IN ANY PUBLIC OR PRIVATE
EVENT IS AT YOUR SOLE AND EXCLUSIVE RISK. THE HOST OF ANY EVENT WHETHER IT BE A
CONNECTIONCAFE AFFILIATE OR ANOTHER MEMBER MAY REFUSE ADMITTANCE, MAY CHARGE AN
ADMISSION FEE, OR ASK YOU TO LEAVE AN EVENT AT ANY TIME FOR ANY REASON. BY
USING CONNECTIONCAFES YOU AGREE AND UNDERSTAND THAT IN CONNECTION WITH YOUR
PARTICIPATION IN ANY EVENT OR ACTIVITY, YOU MAY BE EXPOSED TO A VARIETY OF
HAZARDS AND RISKS, FORESEEN OR UNFORESEEN, WHICH MAY OR MAY NOT BE INHERENT IN
THOSE ACTIVITIES AND EVENTS. THESE INHERENT RISKS INCLUDE, BUT ARE NOT LIMITED
TO, THE DANGERS OF SERIOUS PERSONAL INJURY, PROPERTY DAMAGE, AND DEATH
(INJURIES AND DAMAGES) FROM EXPOSURE TO THE HAZARDS OF PUBLIC OR PRIVATE OUTINGS
AND ACTIVITIES. CONNECTIONCAFES HAS NOT TRIED TO CONTRADICT OR MINIMIZE YOUR
UNDERSTANDING OF THESE RISKS. BY USING CONNECTIONCAFES , YOU AGREE AND
UNDERSTAND THAT INJURIES AND DAMAGES CAN OCCUR BY NATURAL CAUSES OR BY THE ACTS
OF OTHER PERSONS OR THIRD PARITIES, EITHER AS A RESULT OF NEGLIGENCE OR BECAUSE
OF OTHER REASONS. YOU ARE PERSONALLY RESPONSIBLE FOR ALL COSTS AND/OR RISKS
ASSOCIATED WITH ANY PUBLIC OR PRIVATE EVENT OR ACTIVITY. NOTWITHSTANDING
ANYTHING TO THE CONTRARY HEREIN, TO THE FULLEST EXTENT ALLOWED BY LAW, YOU

LIABILITY AND INDEMNIFY AND HOLD HARMLESS CONNECTIONCAFES , ITS SUBSIDIARIES,
AFFILIATES, OFFICERS, AGENTS, AND OTHER PARTNERS AND EMPLOYEES, FROM ANY AND ALL
LIABILITY ON ACCOUNT OF, OR IN ANY WAY RESULTING FROM INJURIES AND DAMAGES IN
ANY WAY CONNECTED WITH ANY EVENTS OR ACTIVITIES. YOU AGREE AND UNDERSTAND AND
INTEND THAT THIS ASSUMPTION OF RISK AND RELEASE IS BINDING UPON YOU AND YOUR
HEIRS, EXECUTORS, AGENTS, ADMINISTRATORS AND ASSIGNS, AND INCLUDES ANY MINORS
ACCOMPANYING.
ConnectionCafes shall not be liable for
your interactions with any organizations and/or individuals found on or through
ConnectionCafes . This includes, but is not limited to, payment and delivery of
goods and services, and any other terms, conditions, warranties or
representations associated with such dealings, the behavior/conduct of members
who may attend your events, the # of members who attend your events, and
whether or not members who “RSVP” attend your events or not, and any content
you read/receive from other members online at ConnectioncCafes or offline
should you choose to meet them. These dealings are solely between you and such
organizations and/or individuals. ConnectionCafes is under no obligation to become involved in
disputes between members/visitors/affiliates of ConnectionCafes , or between
members/visitors/affiliates of ConnectionCafes and any third party

Reviews
Members may post reviews on participating ConnectionCafes Affiliates. A link to
your profile is placed on any review you post.
We do not allow “anonymous” reviews.
We reserve the right to delete a review if it violates our Content
Guidelines or any other reason we determine
necessary at our sole discretion and without notice to the reviewer.
h.
Public
Forums (My Messages > Bulletin Board)
In addition to
private communication between members, ConnectionCafes provides a public forum
and/or classifieds section where both members and visitors may post messages which
are available for all visitors to the site to read. These messages are subject to the Terms of
Service Content guidelines, and as with
all content posted that you access when visiting the
site, you acknowledge that all posts made to these forums express the views and
opinions of the member and/or visitor and not ConnectionCafes, it’s owners,
administrators, and you understand that by using the service in
general and the forum in particular, you may be exposed to Content that is
offensive, indecent or objectionable and you agree that under no circumstances
will ConnectionCafes be liable in any way for any Content posted, emailed or
otherwise made available via the service.
i.
Instant
Messaging
Members with
profiles may request, accept and otherwise engage in one on one Instant
Messaging with one another via the site, including text, video and or audio.
a.
Text
Text messaging is subject to the same “word filter” used for mailbox and forum
messaging and is meant to restrict/limit/eliminate a member receiving spam,
solicitations, obscene language or other text content prohibited by the Content
Guidelines. ConnectionCafes makes no warranty that this word filter is complete
or to your satisfaction and that even with the word filter on you will not
receive words/thoughts/content that you do find objectionable.
You may turn the word filter on at anytime for any specific user after
acknowledging that you have done so and are allowing unrestricted content to be
sent from the other user and that you may be exposed to Content that is
offensive, indecent or objectionable and you agree that under no circumstances
will ConnectionCafes be liable in any way for any Content posted, emailed or
otherwise made available via the service.
b.
Video/Audio
ConnectionCafes does
not monitor or censor or restrict video or audio transmissions from any member
to another member using the ConnectionCafes Instant Messenger. Prior to sending
or receiving video you will need to acknowledge that they are receiving
unrestricted content and that you may be exposed to Content that is offensive,
indecent or objectionable and you agree that under no circumstances will
ConnectionCafes be liable in any way for any Content posted, emailed or
otherwise made available via the service.
j.
Reporting Abuse
If you receive mailbox or instant text/video/audio messages or read a Bulletin
Board post you feel violates the Terms of Service Agreement Content Guidelines,
you may report the message using the Report Message Button included with each
message/chat. Doing so will;
a.
Block
the other member from further contact with you until/unless you remove the
Block from the > Blocked list on the Find Members Page while logged into
your account.
b.
File
a Report Message/Chat with ConnectionCafes. As per the Terms of Service Agreement
frivolous or malicious use of the Report System may result in the suspension or
termination of a users profile/membership, please use it with care and fairness
in mind.
c.
In the general course of operations, all of the
private correspondence between members including mailbox messages and instant
messages, whether text, video or audio content remains private between users
and only mailbox messages (text/video/audio) are saved for the
sending/receiving users exclusive access. Instant Message conversations are not
saved once the conversation has been closed by both users.
d.
However, In the event
a Message is reported the content of that message/chat will be saved and
available for review by ConnectionCafes Administration to assess whether it in
fact violates the Content Guidelines (see Terms of Service).
e.
Following the review the reported member may or may
not have his/her profile suspended and/or terminated.
f.
As
per the Terms of Service Agreement frivolous or malicious use of the Report
System may result in the suspension or termination of a users
profile/membership, please use it with care and fairness in mind.
2.
Proprietary
Rights
e.
You
may not up load, distribute, post, or reproduce any copyrighted material,
trademarks, or other proprietary information without first obtaining the prior
written consent of the owner of such proprietary rights.
f.
You
acknowledge and agree that the Service and any necessary software used in
connection with the Service ("Software") contain proprietary and
confidential information that is protected by applicable intellectual property
and other laws. You further acknowledge and agree that Content contained in
sponsor advertisements or information presented to you through the Service or
advertisers is protected by copyrights, trademarks, service marks, patents or
other proprietary rights and laws. Except as expressly authorized by
ConnectionCafes.com or advertisers, you agree not to modify, rent, lease, loan,
sell, distribute or create derivative works based on the Service or the
Software, in whole or in part.
g.
ConnectionCafes.com
grants you a personal, non-transferable and non-exclusive right and license to
use the object code of its Software on a single computer; provided that you do
not (and do not allow any third party to) copy, modify, create a derivative
work of, reverse engineer, reverse assemble or otherwise attempt to discover
any source code, sell, assign, sublicense, grant a security interest in or
otherwise transfer any right in the Software. You agree not to modify the
Software in any manner or form, or to use modified versions of the Software,
including (without limitation) for the purpose of obtaining unauthorized access
to the Service. You agree not to access the Service by any means other than
through the interface that is provided by ConnectionCafes.com for use in
accessing the Service.
h.
If
you believe that your work has been reproduced onsite or in any printed
Matchbooks in a way that constitutes copyright infringement, or your
intellectual property rights have been otherwise violated, please provide
ConnectionCafes.com 's Copyright Agent the following information: (1) an
electronic or physical signature of the person authorized to act on behalf of
the owner of the copyright or other intellectual property interest; (2) a
description of the copyrighted work or other intellectual property that you
claim has been infringed; (3) a description of where the material that you
claim is infringing is located on the site; (4) your address, telephone number,
and email address; (5) a statement by you that you have a good faith belief
that the disputed use is not authorized by the copyright owner, its agent, or
the law; (6) a statement by you, made under penalty of perjury, that the above
information in your Notice is accurate and that you are the copyright or
intellectual property owner or authorized to act on the copyright or

PRINT QUALITY OF YOUR PHOTOGRAPH WILL BE TO YOUR SATISFACTION. YOU ARE
RESPONSIBLE FOR UPLOADING AN IMAGE OF SUFFICIENT RESOULTION TO PRINT LEGIBLY (200
PIXELS WIDE AND/OR HIGH IS RECOMMENDED)

TO LOST, STOLEN OR DEFACED MATCHBOOKS ONCE THE CAFE HAS TAKEN DELIVERY OF THEM

AMOUNT OF PARTICIPATING CAFES IN ANY

YOU JOIN THE SERVICE AND RESIDE IN A REGION WITH NO PARTICIPATING CAFES IN
ORDER TO REQUEST OR BE REQUESTED IN A REGION WITH PARTICIPATING CAFES THAT NEW
PARTICIPATING CAFES IN YOUR REGION SHALL JOIN THE SERVICE.

GIVEN CATEGORY (M4W, W4M, M4M, W4W) REQUEST TO BE PRINTED IN THAT CAFÉ. MEMBERS ARE ADDED TO THAT PRINT QUEUE IN THE
ORDER THEY SUCCESFULLY MAKE A PRINT REQUEST/ORDERIS ONLINE AT WWW.CONNECTIONCAFES.COM.

SATISFACTION. YOU ARE RESPONSIBLE FOR UPLOADING AN IMAGE OF SUFFICIENT

YOUR MAILBOX OR INSTANT CHAT SESSIONS FROM OTHER MEMBERS.

POSSIBILITY OF SUCH DAMAGES.

You are solely responsible for maintaining the confidentiality of your password
